HR6090, SB3141 & SB4137 Intend To Limit Rights Protected By The First Amendment

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; in abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble; and to petition the government for a redress of grievances – First Amendment, The Constitution for the united States of America.

Simple and to the point is this recognition of the rights of the people where these five activities are concerned. By now, the people have become familiar with HR 6090, Antisemitism Awareness Act of 2023, passed by the House of Representatives. Two “sister” bills exist in the Senate – SB 3141 and SB 4127 – carrying the same title but with the year 2024 attached. All of these bills seek to codify into law the International Holocaust Remembrance Alliance’s “working definitions of antisemitism” to include the following “contemporary examples of antisemitism in public life, the media, schools, the workplace, and in the religious sphere could, taking into account the overall context, include, but are not limited to:

  1. Calling for, aiding, or justifying the killing or harming of Jews in the name of a radical ideology or an extremist view of religion.
  2. Making mendacious, dehumanizing, demonizing, or stereotypical allegations about Jews as such or the power of Jews as collective — such as, especially but not exclusively, the myth about a world Jewish conspiracy or of Jews controlling the media, economy, government or other societal institutions.
  3. Accusing Jews as a people of being responsible for real or imagined wrongdoing committed by a single Jewish person or group, or even for acts committed by non-Jews.
  4. Denying the fact, scope, mechanisms (e.g. gas chambers) or intentionality of the genocide of the Jewish people at the hands of National Socialist Germany and its supporters and accomplices during World War II (the Holocaust).
  5. Accusing the Jews as a people, or Israel as a state, of inventing or exaggerating the Holocaust.
  6. Accusing Jewish citizens of being more loyal to Israel, or to the alleged priorities of Jews worldwide, than to the interests of their own nations.
  7. Denying the Jewish people their right to self-determination, e.g., by claiming that the existence of a State of Israel is a racist endeavor.
  8. Applying double standards by requiring of it a behavior not expected or demanded of any other democratic nation.
  9. Using the symbols and images associated with classic antisemitism (e.g., claims of Jews killing Jesus or blood libel) to characterize Israel or Israelis.
  10. Drawing comparisons of contemporary Israeli policy to that of the Nazis.
  11. Holding Jews collectively responsible for actions of the state of Israel.

Read these 11 “contemporary examples” carefully since the House passed legislation, which now heads to the Senate, and the proposed Senate bills, seek to make these “contemporary examples” part of the definitions of antisemitism law.

Could not these bills be said to “establish a religion” and prohibit the “free exercise” of the Christian religion, i.e. speaking the Gospel message to those who do not believe in Our Lord and Savior Jesus Christ? It’s an honest question. Read this excellent paper by Joanna Martin, JD, aka Publius Huldah, to learn how the Supreme Court usurped the definition of “establishment of religion” from mandatory taxes or tithes for the “established” denomination to “a religious activity”.

Interesting that it is the Department of Education that gets to decide whether Title VI of the Civil Rights Act of 1964 has been violated with respect to “discrimination” based upon perceived or actual Jewish ancestry or ethnic characteristics. (HR 6090, Section 5). Yet, the District of Criminals that have hijacked our republic can continue to “aid” those with “radical ideology or an extremist view of religion” – think Muslim Brotherhood, Hamas, Hezbollah, and others calling for the eradication of all religions except Islam. Clearly, this law is targeted toward government indoctrination and brainwashing centers known as public schools and universities.

What is missing in this proposed legislation is the punishment, fines, etc. for violations, meaning the Department of Education will determine that since it is being given the pretended authority to determine when this unconstitutional law has been violated.

This unconstitutional piece of legislation now prohibits ignorant speech, but then claims in Section 6 “Nothing in this act shall be construed to diminish or infringe upon any right protected under the First Amendment to the Constitution of the United States.” Seriously, it just did where students in government indoctrination and brainwashing centers are concerned, as well as for faculty and anyone on “government property” – K-12 public schools, colleges, and universities. How long before this “legislation” is expanded to include everyone?

While Christians are commanded by God in Exodus 20, verse 16, “Thou shalt not bear false witness against thy neighbor” (KJV); Proverbs 12:22 reveals, “The Lord detests lying lips …”; and Hosea 4:6 speaks against ignorance “My people are destroyed for lack of knowledge, …” freedom of speech and freedom of the press are commanded to be truthful and knowledgeable. However, even the people of God sometimes speak with ignorance, which the First Amendment recognizes, protects, and guarantees along with personal opinions and beliefs. At what point in time has not someone made “mendacious, dehumanizing, demonizing, or stereotypical allegations” against another? That type of speech is born out of ignorance, but it isn’t illegal anywhere – until now, and where the unconstitutional Department of Education “claims” jurisdiction but only applicable to those of the Jewish faith.

The individual States have authority over libelous and slanderous speech as evidenced by the laws passed concerning such. Now, the corrupt District of Criminals is moving to limit speech in all States through this legislation giving broad powers to the Department of Education.

Particularly of note are the contemporary examples six through eleven. These contemporary examples prohibit any speech concerning the geopolitical State of Israel. Basically, whatever the geopolitical State of Israel does is exempt from criticism, including if the nation-state violates the rights of any individual or group of people, such as Christians, people living in Gaza, or other nationalities and other nation-states. According to contemporary example number seven, “claiming the existence of the State of Israel is a racist endeavor” equates to “denying the Jewish people of a right to self-determination”. By the same token, isn’t the geopolitical State of Israel denying the right of self-determination to the people of Gaza? Gaza is occupied by Arabs, Muslims, Christians, and some individuals of Jewish ancestry, along with those holding “extremist religious views”. It’s an honest question since all people have the right of self-determination. There isn’t anyone who can say the people living in Gaza want to be under the thumb of Hamas; but, no one can say the people living in Gaza want to be under the geopolitical State of Israel thumb either. Certainly, no one living in Gaza wants to be bombed, terrorized, imprisoned, or shot at by either Hamas or the geopolitical State of Israel.

If you reference the Holy Bible, where it is said numerous times that Jesus Christ was handed over to the Romans by the “Hebrews” (some say Jews) of the day, you have committed an act of antisemitism. Quoting factual accounts contained in the Bible by “students” will place them in violation of this “legislation”, should it pass the Senate, making them subject to whatever “rules” the Department of Education establishes to inflict punishment upon violators.

How long before this is extended to cover Catholic or protestant places of worship and theological seminaries?

What else does this legislation cover? It covers the May 26, 2016 definition of “antisemitism” – Antisemitism is a certain perception of Jews, which may be expressed as hatred toward Jews. Rhetorical and physical manifestations of antisemitism are directed toward Jewish or non-Jewish individuals and/or their property, toward Jewish community institutions and religious facilities.

In this definition, it does not distinguish between those of the Jewish faith and Zionists. However, this next paragraph is missing from the recently passed House and proposed Senate bills.

Manifestations might include the targeting of the state of Israel, conceived as a Jewish collectivity. However, criticism of Israel similar to that leveled against any other country cannot be regarded as antisemitic. Antisemitism frequently charges Jews with conspiring to harm humanity, and it is often used to blame Jews for “why things go wrong.” It is expressed in speech, writing, visual forms and action, and employs sinister stereotypes and negative character traits. [Emphasis Mine.]

It is the underscored portion that is most important and was conspicuously missing from the bills. But the entire paragraph has meaning. What people “believe” may or may not be true, but there is no law that states what you have to believe and no law that prevents you from expressing those beliefs – until these bills. Whether what you believe is true or not, you have the right to believe it as you cannot legislate ethics or morality, and by extension what someone thinks or believes – right or wrong. It is when one acts on those beliefs that results in injury upon another or another’s property does it become criminal – the act would be criminal, not the belief.

The following is included under the “contemporary examples”, although not listed in the House and Senate bills. Will the Department of Education view these as “examples”?

Antisemitic acts are criminal when they are so defined by law (for example, denial of the Holocaust or distribution of antisemitic materials in some countries). [Number four under the “contemporary examples” just made denial of the Holocaust a criminal act.]

Criminal acts are antisemitic when the targets of attacks, whether they are people or property – such as buildings, schools, places of worship and cemeteries – are selected because they are, or are perceived to be, Jewish or linked to Jews. [Attacks on people and property are already a criminal offense in the united States.]

Antisemitic discrimination is the denial to Jews of opportunities or services available to others and is illegal in many countries. [According to the Pew Research Center survey reported on May 11, 2021, “An overwhelming majority of Jewish Americans say there is at least some anti-Semitism in the U.S. today (93%), including 45% who say there is “a lot” of anti-Semitism and 47% who say there is “some.”]

What is left out of this legislation is as important as what it contains. Because the legislation did not include the text “criticism of Israel similar to that leveled against any other country cannot be regarded as antisemitic”, it will be left to the Department of Education to determine IF that will be exempt.

And, what about number 10 – “drawing comparisons of contemporary Israeli policy to that of the Nazis”? The Nazi German government targeted for extermination Jews, the mentally and physically disabled German people, the elderly, the infirmed, the homosexuals, the Gypsies, the Slavic people, political opponents, and Christians who spoke against the government. For anyone NOT considered Aryan enough, by their own warped standards, the Nazi German government forcefully sterilized many of their own people. An honest question to ask is “what is happening in Gaza”? How can intellectual, educated, conversation take place to exchange ideas on international events at colleges and universities if one cannot discuss the geopolitical State of Israel policy as it may compare to actions taken by the Nazi German government?

These bills could be said to shake the foundation of the God-given individual rights recognized, protected, and guaranteed in the First Amendment by prohibiting these activities when these activities can be cited as “antisemitic” using the definitions contained in these unconstitutional bills. As we know sewage flows downhill, expect the state and local governments’ indoctrination and brainwashing centers to take center stage in violating that which should be protected. Get your children out of public schools, colleges, and universities. Even private higher education centers and private schools may not be exempt.

When was the last time the US Congress legislated FOR the American people? The halls of Capital Hill are filled with legislation for Ukraine, China, Israel, and everybody and his brother except the American people Congress finds distasteful. American liberties are under attack with these bills, as well as anyone who disparages the geopolitical State of Israel, even if what is being said is truthful.
